Protecting Your Brand in Nepal: Trademark, Patent and Copyright Basics

नेपालमा ट्रेडमार्क, पेटेन्ट र प्रतिलिपि अधिकार — आधारभूत जानकारी

Your business name, logo, product designs and creative work are among your most valuable assets. In Nepal, registering them gives you clear legal rights to stop others from copying or misusing them.

What can be protected?

  • Trademark – your brand name, logo or slogan. Registered with the Department of Industry under the Patent, Design and Trademark Act, 2022 (1965).
  • Patent – a new invention or technical process.
  • Industrial design – the shape or look of a product.
  • Copyright – books, music, films, software and artwork, under the Copyright Act, 2059. Copyright exists automatically, but registering it with the Copyright Registrar’s Office makes proof much easier.

Why register early?

  • In Nepal, trademark rights generally go to whoever registers first, so delay can let someone else claim your brand.
  • A registration certificate is strong evidence if you need to take action against copying.
  • Registered rights add value when you seek investment, franchise or sell your business.

Basic steps for trademark registration

  1. Search existing marks to make sure yours is not already taken.
  2. File the application with the logo, the list of goods or services and business documents.
  3. The application is examined and published so others can object.
  4. If there is no successful objection, the certificate is issued. Remember to renew it on time.
